Ending a Badante Contract When a Parent Enters an RSA

When a parent enters an RSA, the live-in carer’s job does not simply disappear. The family may be an employer with duties concerning notice, final pay, unused leave, the additional monthly salary, severance and social-security communication. At the same time, the worker may hold the most accurate knowledge of medicines, routines, appetite and recent changes. Treating employment closure and care handover as one rushed conversation creates both legal and clinical risk.

First identify the formal employer and the applicable domestic-work contract, payslips and contribution history. The comparison of a badante and residential care can support the care decision, but it does not calculate the individual employment settlement. Use a qualified payroll or labour adviser for the actual figures and deadlines.

Confirm the employment record before giving notice

Collect the hiring communication, contract, job level, start date, agreed hours, live-in status, wage records, INPS contributions, leave taken, advances and any prior changes. Compare the paperwork with how the job operated in practice. Missing payslips or informal overtime should be resolved rather than ignored because the parent is moving.

Record who is authorised to act for the employer. An adult child who arranged rotas may not be the contracting employer or legal representative. If the parent cannot manage the process, obtain advice on lawful representation. Keep discussions respectful and private; telling the care home or neighbours before informing the worker can damage trust and complicate the handover.

Choose and document the correct ending date

Work backwards from the confirmed RSA admission, not a hoped-for bed date. Decide whether the worker will remain through packing, travel or the first transition days, and whether live-in accommodation ends at the same time as employment. Check the applicable notice rule, who gives notice and whether payment in lieu may arise. Illness, leave or another protected situation may affect the process and needs individual advice.

Give a written communication that states the last working day, practical duties until then, return of property and contact for payroll questions. Do not label the reason casually or pressure the worker to sign a resignation. If the RSA admission is postponed, document any agreed change instead of allowing an uncertain verbal extension.

Reconcile final pay item by item

Ask the payroll adviser for a transparent calculation separating ordinary wages, overtime or allowances, accrued and unused holiday, the accrued thirteenth-month element, notice or indemnity where applicable, and trattamento di fine rapporto. Make the INPS cessation communication on time

The employer must ensure that cessation of domestic employment is communicated to INPS through the accepted channel within the applicable deadline, generally five days. Verify that the recorded last day and reason match the employment documentation. Save the protocol or receipt; stopping quarterly contributions or closing a bank transfer does not replace the formal communication.

Check whether any outstanding contribution period, correction or payment remains after cessation. Keep access to the employer’s social-security records until the final position is reconciled. If an intermediary submits the communication, request the receipt rather than assuming it was done. Turn the carer’s knowledge into a safe handover

With the parent’s authority and appropriate privacy safeguards, ask the worker to describe the daily baseline: transfers, toileting, food texture, sleep, distress cues, preferred routines, glasses, hearing aids, skin issues and recent changes. Clinical facts and prescriptions still need professional confirmation, but practical observations help the RSA understand what a brief assessment may miss.

Use a dated handover form rather than an informal voice message. Return medicines to the responsible person, list last doses and identify supplies belonging to the parent. Do not ask the former worker to remain an unpaid on-call adviser. If occasional future visits or paid support are wanted, create a clear new arrangement rather than letting the old employment relationship blur.

Close access, accommodation and household property

Inventory keys, alarm codes, cards, cash floats, devices and documents without implying wrongdoing. Change access only after the agreed final duties are complete, unless a specific safety issue requires earlier action. If the worker lived in the parent’s home, plan the return of personal belongings and clarify the date accommodation ends with appropriate advice.

Notify only organisations that need to know and redirect routine contacts to the new representative. Preserve dignity in front of the parent, who may experience the employment ending as another loss. Create a closure sheet signed or acknowledged by the people responsible for payroll, property and care. It should show the final shift, keys returned, cash reconciled, last medicines and meals recorded, personal belongings collected, INPS receipt obtained and the date the final statement was delivered. Record disagreements as open items rather than forcing a “nothing further is owed” declaration. Where the parent and worker had a close bond, agree whether a farewell or later visit is wanted, while making clear that emotional contact does not extend employment duties or unpaid availability.

Can the family end the badante contract on the RSA admission day?

The timing must respect the applicable contract, notice and individual circumstances. Plan from the confirmed admission date and obtain payroll or labour advice. A sudden bed offer does not erase accrued employment rights or required communication.

Which final amounts normally need checking?

Check wages, documented extras, accrued holiday, the thirteenth-month element, notice consequences, severance and contributions. The exact calculation depends on the contract and record; it should be produced for the case rather than copied from a general example.

Is telling INPS enough to complete the whole closure?

No. The INPS cessation communication is one formal step. Payroll, payment, documents, property, accommodation and care handover still require separate completion and evidence.
